Premier Fresh Australia Pty Ltd (Premier Fresh) proposes to acquire 100% of the shares in North Queensland IQF Pty Ltd and Double D Produce Pty Ltd (collectively, the Domenico Group), land containing a plant used by the Domenico Group, and leases of the farmland used by the Domenico Group (the Acquisition).
The Domenico Group is a Queensland-based grower and processer of fresh and frozen vegetables (predominantly capsicums). The Domenico Group does not directly supply fresh capsicum to end customers or retailers. Instead, it supplies fresh capsicum to intermediate wholesalers, such as Premier Fresh.
Premier Fresh is a fresh vegetable wholesaler. Premier Fresh is a longstanding customer of Domenico Group and acquires the majority of the fresh capsicum produced by the Domenico Group. Premier Fresh does not grow capsicums other than on a trial basis from time to time. Premier Fresh also occasionally acquires melons from Domenico Group.

The ACCC’s ability to give detailed consideration to submissions received after this time may be limited.
